GENERAL CONDITIONS OF SALE AND USE - Javapublishing

Javapublishing sarl, limited liability company with capital of 7,623 euros, registered in the TOURS trade and companies register under number 418561221, whose registered office is located at 1 rue du Moulin Brûlé 37530 Mosnes (hereinafter Javapublishing sarl), publisher and operator of the site "https://javapublishing.com" (hereinafter the "Site"), has established the general conditions of sale and use (hereinafter the "CGV-CGU"), governs the access and use of the Site.
They also set the terms and conditions under which Javapublishing sarl agrees to supply the products (hereinafter the "Products") presented on the Site.
The Products offered on the Site are reserved for individuals and are not intended for professional use.

ARTICLE 1. ACCEPTANCE OF THE CGV-CGU
Before any use of the Site or purchase of Products on the Site, you acknowledge having read these T&Cs and you apply them without restriction or reservation.
You declare that you are legally capable of contracting.
These CGV-CGU also apply to any variation or extension of the Site on social or community networks, or application, existing or future.
We advise you to download and/or print them so that you can keep them and refer to them in the future.

ARTICLE 2. ACCESS TO THE SITE
Access, consultation and use of the Site are strictly reserved for persons aged 18 or over.
To access the Site, you must have terminal equipment connected to the internet. You bear all the costs relating to your digital environment (hardware, software and network connection), in particular the costs of connection to the Internet.
Javapublishing sarl may refuse access to the Site to any person who does not comply with these T&Cs.

ARTICLE 3. REGISTRATION
Access to certain Products requires the creation of a personal account.
Registration is free. It is done by completing the online form provided for this purpose. To do this, you must provide the following information:

You agree to provide accurate and sincere information concerning.
A confirmation e-mail is then sent to you at the address indicated, with a summary of the connection information.
The connection identifier is personal and cannot be used by several people, nor be sold, rented, or transferred in any way whatsoever.
The password is confidential and must not be communicated to a third party. It can be modified from your personal space. You must implement all necessary measures to protect your password.
You also agree to inform Javapublishing sarl, by any means and as soon as possible, in the event of observation or suspicion of fraudulent or unauthorized connection to your account.
You can at any time request your unsubscription and the deletion of your account, from your personal space, or by e-mail at the following address: contact@javapublishing.com.
Javapublishing sarl reserves the right to delete your account without notice in the event of violation of these T&Cs, and in particular:
      • In the event of use contrary to the legislation in force;
      • In case of fraudulent use or usurpation of the identity of a third party;
      • In the event of infringement of the rights of Javapublishing sarl or of a third party.
Javapublishing sarl may also delete your account in case of inactivity for more than one (1) year.

ARTICLE 4. PRODUCTS
The essential characteristics of the Products offered are presented on the Site.
You acknowledge having read this information prior to any order.

ARTICLE 5. ORDERS
Orders are made online via the Site.
To place an order, you must select the desired Products to add them to your basket.
You must then validate the details of your basket, the total price, or correct any errors, and indicate your billing and delivery address, as well as your means of payment.
You definitively confirm your order by clicking on the payment button. This confirmation is equivalent to an electronic signature on your part, equivalent to a handwritten signature, and firm and definitive acceptance of the sale.
Once payment has been accepted, the order is validated as soon as possible by sending an acknowledgment of receipt by e-mail to the address you have chosen.
The Products are offered within the limits of available stocks. In the event of unavailability, an equivalent Product may be offered to you. In case of refusal on your part, your order will be canceled and fully refunded.
Javapublishing sarl reserves the right to refuse an order of Products in abnormal quantities.

ARTICLE 6. DELIVERY

The Products are supplied in the European Union, Asia and North America
Delivery is made to the address you indicated, within the time specified at the time of the order. The time varies depending on the delivery method chosen.
You are required to personally receive the Products, or designate a third party for this purpose.
Product delivery is ensured by the carrier designated by Javapublishing sarl. It is effected by handing over to you, or to the designated third party, physical possession or control of the Product. For security reasons, some bottles are packaged in specific packaging.
Indeed, thanks to suitable packaging, the bottles travel more safely.
You are required to check the condition of the Products upon receipt. In the event of an anomaly (incomplete order, damaged, torn, open packaging, etc.), you must refuse delivery, indicating your reservations on the delivery note and informing the carrier of the defects noted. You can also inform Javapublishing sarl at the contact details given below.
Javapublishing sarl cannot be held responsible for the delay or the impossibility of delivering an order due to an error on your part in the indication of your contact details. In this case, Javapublishing sarl reserves the right to suspend delivery until the problem is resolved.

ARTICLE 7. FINANCIAL CONDITIONS
1. Price
The prices are indicated on the Site in euros, all taxes included. They take into account the VAT in force on the day of the order.
Javapublishing sarl reserves the right to modify them at any time. The price applied is that in force at the time of confirmation of the order.
Any delivery costs for Products are applied in addition. Their amount is indicated at the time of confirmation of the order.
Exceptionally, in case of erroneous indication of a manifestly derisory price compared to the real value of the item, the order may be cancelled.
The Products remain the property of Javapublishing sarl until full payment of the price.

2. Payment
Payment is made by credit card via a secure system or as follows: Paypal, transfers.
Your payment method is debited when ordering.
Any refusal of payment or partial payment results in the automatic cancellation of the order, of which you will be informed by e-mail.
You expressly declare that the invoices are sent to you in electronic format.
Javapublishing sarl also reserves the right to refuse any order in the event that you have not fully or partially paid for a previous order or in the event that a dispute is in progress.
The data recorded by Javapublishing sarl is proof of the transactions concluded on the Site.

ARTICLE 8. RIGHT OF WITHDRAWAL
1. Legal right of withdrawal
The consumer customer has a legal right of withdrawal provided for by article L221-18 of the Consumer Code.
You can exercise your right, without having to justify your decision, within 14 days of receipt of the Products by you or the third party, other than the carrier, that you have designated.
In the case of an order for several Products delivered separately or in the case of an order for a Product made up of batches or multiple parts whose delivery is staggered over a defined period, the period runs from receipt of the last Product or batch or last piece.
For contracts providing for the regular delivery of Products during a defined period, the period runs from the receipt of the first Product.
To exercise your right, you must inform Javapublishing sarl of your decision to withdraw by sending, before the expiry of the time limit, the withdrawal form, the model of which appears in the appendix below, or any other declaration, devoid of ambiguity, expressing your wish to retract, to the following coordinates:

You must return or return the Products to Javapublishing sarl, without undue delay and, at the latest, within 14 days following the communication of your decision to withdraw.
The cost of returning the Products is your responsibility.
You may be held liable in the event of depreciation of the Products resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of these Products.
Javapublishing sarl will reimburse you for all sums paid, including delivery costs, without undue delay and at the latest within 14 days from the date on which it is informed of your decision to withdraw.
Unless it has offered to recover the Products itself, Javapublishing sarl may defer reimbursement until the Products are recovered or until you have provided proof of shipment of these Products, the date retained being that of the first of these facts.
Javapublishing sarl will make the refund using the same means of payment as that used for your purchase, unless you expressly agree to use another means of payment and insofar as the refund does not incur any costs for YOU.
Javapublishing sarl is not required to reimburse additional costs if you have expressly chosen a more expensive delivery method than the standard delivery method offered by Javapublishing sarl.

2. Exceptions to the right of withdrawal
In accordance with article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised in the following cases:
      • The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations in the market beyond the control of Javapublishing sarl;

You have the possibility to publish the following content on the site:

You remain responsible for the content you post on the Site. As such, you agree not to publish content that is illegal or infringes the rights of third parties, or that is shocking, violent, pornographic, inciting hatred or discrimination.
By publishing on the Site, you grant Javapublishing sarl a free license authorizing it to reproduce, represent and adapt the content you publish, for advertising or commercial purposes, by any means and on any medium known or unknown to date, worldwide and for the entire duration of its legal protection.
Javapublishing sarl reserves the right to refuse or delete any published content, without notice or justification.

ARTICLE 11. RESPONSIBILITIES
Javapublishing sarl has implemented its best efforts to provide accurate and up-to-date information and content on the Site, without however being able to guarantee the performance, completeness or reliability of this information and content.
Javapublishing sarl is not responsible for technical, computer or compatibility problems or failures affecting the availability or use of the Site, for reasons or circumstances beyond its control.
Javapublishing sarl is not responsible for any damage that may result from the use of the Site, including loss of data, deterioration, destruction or viruses that may affect your computer equipment.

Javapublishing sarl reserves the right to modify, at any time and without notice, these T&Cs, in particular to adapt to changes to the Site by making new features available or deleting or modifying existing features.

ARTICLE 19. PARTIAL NULLITY
If one or more stipulations of these CGV-CGU have been declared void by application of the law, a regulation or a final decision of a French jurisdiction, the other stipulations will retain their full force and scope.

ARTICLE 21. APPLICABLE LAW - DISPUTES
This contract is exclusively subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
